Jamie Spears’ legal team says Britney Spears can file a motion to end her conservatorship “any time,” but hasn’t in the 13 years it has been in place.

In a statement to PEOPLE on Tuesday, Vivian L. Thoreen, Holland & Knight LLP, a lawyer for 68-year-old Jamie Spears, says her best interests are periodically assessed by the courts to ensure wellbeing.

Jamie’s attorney says he has “diligently and professionally carried out his duties as one of Britney’s conservators, and his love for his daughter and dedication to protecting her is clearly apparent to the court.” Thoreen claims “Any time Britney wants to end her conservatorship, she can ask her lawyer to file a petition to terminate it; she has always had this right but in 13 years has never exercised it,” “Britney knows that her Daddy loves her, and that he will be there for her whenever and if she needs him, just as he always has been — conservatorship or not.”

That is definitely not how the situation was portrayed in the recent unauthorized documentary, “Framing Britney Spears”. It portrayed Britney as a prisoner in the arrangement and sparked more validity to the #FreeBritney movement.
